Chapter PD: Introduction to Anti-Money Laundering (AML), Countering the Financing of Terrorism (CFT) & Proceeds of Crime (POC) for Accountants

The objective of this session is to develop a basic understanding of how money laundering is carried out and the compliance and law enforcement initiatives aimed at preventing, investigating and prosecuting money laundering, terrorist financing and proceeds of crimes cases. Theory will be kept to the minimum necessary, with the emphasis throughout on real life cases in Canada and abroad that illustrate core AML/CFT principles.
This seminar is for accountants with little or no background in Anti Money Laundering and Counter-Terrorist Financing.

- Common methods and techniques of money laundering
- Accountants and lawyers as gatekeepers to the financial system
- Proceeds of Crime, Money Laundering and Terrorist Financing Act (PCMLTFA)
- Compliance – FINTRAC, AUSTRAC, FINCEN and similar agencies
- KYC, recordkeeping and other AML regulatory requirements for accountants
- Criminal offences related to money laundering
- Criminal Code special AML police powers
- Police investigations of money laundering
- Role of the accountant in regulatory and criminal investigations
- Preventive accounting – how to avoid a “meaningful experience” with the justice system

Mr. John Ahern is a Vancouver-based lawyer who specializes in providing legal advice and major case management services to investigative agencies, corporations and law firms. He currently serves as National Special Advisor – Financial Crime Investigations for RCMP Federal Policing and as Legal Advisor for the British Columbia Conservation Officer Service.
Prior to returning to private practice in 2017, Mr. Ahern was Senior Crown Counsel with the British Columbia Ministry of Attorney General for more than 20 years, where his Province-wide practice focused on the prosecution of serious financial crime. Mr. Ahern has also practiced civil litigation, representing plaintiffs in civil fraud cases. He is a Certified Fraud Examiner (CFE) and a graduate of the Canadian Securities Course, the Osgoode Hall Law School Intensive Course in Canadian Securities Law and Practice, and the Osgoode Hall Law School Intensive Course on the Toronto Stock Exchange. Before attending law school, Mr. Ahern served 17 years as a peace officer with Canada Customs, the Peel Regional Police and the RCMP.
