1st Afternoon Session: Employment Law Issues – How to avoid litigation

Wrongful dismissal lawsuits are costly both financially and for staff morale; particularly for small businesses. This seminar will revise the current employment law in B.C. as it pertains to employment agreements in professional workplaces. The focus will be on practical suggestions to avoid a legal dispute with an employee, from drafting employment contracts to negotiating severance packages.
Topics will include:
• Drafting employment agreements;
• Contractors versus employees;
• Restrictive covenants;
• Workplace discrimination under the B.C. Human Rights Code;
• Employments Standards Act issues;
• Termination for cause;
• Severance; pay in lieu of notice and working notice;
• Settlement agreements.
Speaker- Matthew Yates graduated with degrees in Law and Commerce from the University of Queensland in Brisbane in 2008. He practiced as a lawyer in Australia primarily in personal injury law at Maurice Blackburn Lawyers before moving to Canada in 2011. Matt was called to the British Columbia bar in 2013 and now practices in civil litigation including family law, employment law and estate disputes. Matthew works at the law firm Stacey, Trillo & Yates in Nelson, where he lives with his Kootenay-born wife and new baby. He is a member of the Kootenay Bar Association and is a volunteer lawyer at the Nelson Advocacy Centre.

Speaker, Justin Dechaine , Key Account Manager at Sitkum IT Managed Services, is a recent resident to the West Kootenay’s. Sitkum IT Managed Services provides proactive and worry free management of all office, computer and network equipment. His primary role is being a liaison to small business’s in the area to both existing customers and potential customers. Justin has had lots of exposure to different fields in Information Technology such as sales working with Networking, Fiber Optics, Telephony, Disaster Recovery systems, Servers and Desktops.
